The World Gym Australia Referral Program is designed to reward current members (“Referrers”) for introducing new members (“Referred Members”) to World Gym Australia (“the Promoter”) by offering two (2) weeks of complimentary membership (“Referral Reward”) to both the Referrer and Referred Member.
1. Promoter
1.1. The Promoter of the ‘Referral Program’ promotion is operated by Pro Arc International Pty Ltd (ABN 12 090 444 867) of registered office address: 6 Peachtree Road Penrith 2750.
1.2. Pro Arc International Pty Ltd is the Master Franchisee of World Gym.
2. Promotion Period
2.1. The Referral Program promotion (“Promotion”) commences when promotional advertisements are first displayed on the Promoter’s website at https://www.worldgym.com.au/ and continues until such time as determined by the Promoter in its absolute discretion (“Promotion Period”).
2.2. the Promotion is only active and valid during periods when promotional advertisements relating to the Promotion are displayed on the Promoter’s website and the removal of such advertisements shall signify the end of the Promotion Period without further notice.
2.3. Upon cessation of the Promotion Period:
a) no further claims or participation in the Promotion will be accepted;
b) any promotional benefits, discounts, or offers associated with the Promotion will cease to be available; and
c) the Promoter may, at its discretion, honour any validly submitted entries or claims received prior to termination.
2.4. The Promoter accepts no liability for any loss or disappointment suffered by any person as a result of the termination of the Promotion.
3. Eligibility
3.1. By participating in this Promotion, both the referring member (“Referrer”) and the person being referred (“Referred Member”) accept these terms and conditions.
3.2. For a Referrer to be Eligible for the Promotion, the Referred Member must sign up for an Eligible Membership at an Eligible Location and comply with the Membership Terms and Conditions, a copy of which is located at www.worldgym.com.au/terms-and-conditions
3.3. Eligible Membership means a World Gym Membership on a 12-month fixed term contract entered into by an individual at an Eligible Location.AR1
3.4. Eligible Location means a participating World Gym facility as advertised by the Promoter from time to time.
3.5. The Referred member must not hold, nor ever held, a World Gym Membership.
3.6. Both the Referrer and Referred Member must comply with these Terms and Conditions to be eligible for the Promotion.
3.7. There is no limit to the number of Referral Rewards that a Referrer is eligible to receive.
3.8. The Referred Member can receive a maximum of one (1) Referral Reward under this Promotion
3.9. The Promotion is not valid in conjunction with any other offer.
4. Promotion Details
4.1. A Referrer and Referred Member are eligible to receive the Referral Reward if:
a) The Referred Member provides details of the Referrer at the time of signing up to a membership agreement; or
b) The Referrer provides contact details of the Referred Member to a World Gym staff member for the purpose of this Promotion prior to the Referred Member entering a Membership Agreement with the Promoter.
4.2. The Membership must meet the following criteria:
a) the payment must be successfully processed and not refunded; and
b) the Friend’s membership must not be cancelled during the cooling off periodAR2 .
4.3. Referral rewards are automatically credited to the relevant accounts and will be actioned within 30 days of the Referred Member’s enrolment.AR3 HL4
4.4. If a Credit is applied based on a referral that does not meet the criteria of a Qualifying Purchase:
a) the Credit will be removed from the Referrers account; or
b) if the Credit has been used, a $25 Charge will be raised on the Referrer’s account.
4.5. Rewards cannot be transferred, exchanged for cash, or combined with other offers unless explicitly stated.
5. Prohibited Activities
5.1. The following activities are strictly prohibited:
a) Offering or requesting referrals websites, forums, or public pages;
b) spamming or sending unsolicited communications;
c) Making false or misleading claims about World Gym or the Promotion; and
d) any other activity that the Promoter deems to be abusive or in violation of the intended spirit of the Promotion.
5.2. The Promoter reserves the right to disqualify any participant and withhold Credit if it suspects fraudulent, abusive or unfair activity.
6. Privacy
6.1. Personal Information collected in connection with this Promotion will be handled in accordance with World Gym’s Privacy Policy available at Needed
6.2. By participating in the Promotion, participants consent to the collection, use and disclosure of their personal information for the purposes of administering the Promotion.
7. General
7.1. These Terms and Conditions are governed by the laws of the relevant jurisdiction in which the participating World Gym club operates.
7.2. The Promoter reserves the right to modify these Terms and Conditions at any time without prior notice.
7.3. The Promoters decision regarding any aspect of the Promotion is final and binding.
7.4. To the maximum extent permitted by law, the Promoter shall not be liable for any loss or disappointment suffered by any person as a result of the termination of the promotion.
8. Disputes
8.1. If an individual has a dispute in relation to their eligibility for the Promotion all inquiries are to be sent to Needed.
8.2. The Promoter reserves the right to determine the outcome of any dispute in its absolute discretion.

4. Eligibility
4.1. Eligible Individual means an individual that enters an Eligible Membership at Eligible Location during the Promotion Period, subject to the Membership Terms and Conditions, a copy of which is located at www.worldgym.com.au/termsandconditions
4.2. By participating in this Promotion, the Eligible Individual accepts these Terms and Conditions.
4.3. An Eligible Individual must not have held a previous membership with the Promotor or attended a World Gym facility, including through the purchase of a casual pass or as part of a previous trial offer.
4.4. Eligible Location means a participating World Gym facility as advertised by the Promoter from time to time.
4.5. Eligible Membership means any paid membership.

4.7. Entry is subject to satisfactory completion of a pre-exercise screening and agreement to the standard guest membership terms.
5. Offer
5.1. The Promoter agrees to credit the agreed number of days of membership fees (“Offer”) for each Eligible Individual opting into the Promotion in accordance with these Terms and Conditions.
5.2. Eligible Individuals will receive the Offer upon sign up to an Eligible Membership and payment of the applicable joining fee and access card fee.
5.3. This offer is non-transferable, not redeemable for cash, and cannot be used in conjunction with any other offer.
6. Cooling Off and Early Termination
6.1. Any termination or cancellation of an Eligible Membership must be in accordance with the World Gym Terms and Conditions including any applicable administration and cancellation fees.
6.2. Members are entitled to a cooling-off period in accordance with the consumer protection legislation applicable in their state or territory of residence. During this cooling-off period, a Member may cancel their membership by providing written notice to the Company. The notice must clearly state the Member's intention to cancel under the cooling-off provision and include their full name, membership number, and contact details. This cooling-off right is in addition to, and does not affect, any other rights or remedies available to the Member under applicable law.
6.3. Upon receipt of such notice, the Company will refund any unused membership fees paid in advance, less a reasonable administration fee not exceeding $200 to cover our processing costs.
6.4. If an Eligible Individual chooses to cancel their Membership during the 3 Week Free Period, the notice period for cancellation will commence at the expiry of the credited time.
7. Privacy
7.1. Personal Information collected in connection with this Promotion will be handled in accordance with World Gym’s Privacy Policy available via the World Gym website at www.worldgym.com.au/privacy-policy

I certify that I have read both sides of this Membership Agreement and understand the terms as stated herein and agree to abide by those terms for the duration of the Agreement and acknowledge receipt of a true copy of this Agreement.
WORLD GYM AUSTRALIA MEMBERSHIP AGREEMENT
1. USE OF FACILITIES
World Gym Australia hereby permits the Member, in consideration of the fees and other amounts agreed to be paid by the Member to World Gym Australia in this Agreement, the reasonable use of the fitness equipment, change rooms and showers, those parts of the premises designated for member use and related facilities (collectively the “Facilities”) during World Gym Australia’s hours of operation in accordance with the terms and conditions expressed in this Agreement and the rules and regulations made by World Gym Australia pursuant to this Agreement in force from time to time. Membership does not include personal training, Kids World visits or other personal services, all of which are extra.
2. WARRANTY AND REPRESENTATIONS OF MEMBER
The Member represents and warrants to World Gym Australia (which warranties and representations the Member acknowledges World Gym Australia is relying upon) the following:
a. The Member has no known medical defects and consults a qualified medical physician on a regular basis;
b. The Member understands that they will be engaged in physical exercise which could, if not undertaken in a reasonable and responsible manner relative to the Member’s physical condition, result in personal injury;
c. The Member will obey all rules and regulations of World Gym Australia.
d. The Member will conduct themselves responsibly at all times and use the facilities within the physical limitations of the Member;
e. The Member has read and understands the terms and conditions of this Agreement.
f. You acknowledge that you are solely responsible for determining if you are physically and/or sufficiently fit to utilise the Facilities.
3. WAIVER OF LIABILITY AND DISCLAIMER BY MEMBER
The Member acknowledges and agrees that:
a. The fees and other charges paid for membership to World Gym Australia are for use of the Facilities only;
b. Use of the Facilities is at the Member’s sole risk and the fees and other charges paid do not include insurance for personal injury to the Member, any damages following therefrom or damage or loss to Member’s property;
c. The Member assumes all risk for personal injury;
d. The Member hereby fully releases World Gym Australia, its shareholders, directors, officers, employees, those for which World Gym Australia is responsible at law or otherwise, the landlord of the premises and any other party or parties related to any of the foregoing persons from any and all claims, demands, damages, rights of action, or causes of action, present or future, whether the same be known or unknown, anticipated or unanticipated, resulting from or arising out of the Member’s use or intended use of the Facilities. Nothing in this disclaimer excludes or seeks to exclude significant personal injury suffered as a result of the reckless or negligent conduct of World Gym Australia.
e. World Gym Australia is fully released from any liability whatsoever or howsoever caused for any theft or damage to the Member’s personal property;
f. The Member shall not make any claim or demand or commence any action against any third-party who might claim contribution, indemnity or other relief over and against any person or persons referred to in clause 3(d) above;
g. The Member shall not join, assist, and/or act in concert in manner whatsoever or howsoever with any other person, firm or corporation in making any claim or demand or the bringing of a proceeding or action in any manner against those persons set out in clause 3(d) above;
h. The Member understands this Waiver of Liability, Disclaimer and Release may be raised as an estoppel and a complete bar to any demand, action, claim, proceeding or complaint made against World Gym Australia or any of the persons named in 3(d) hereof arising with respect to the matters above released and discharged.
i. You agree to indemnify World Gym Australia, its past and present employees, officers, supplies, representatives, volunteers and agents from any and all third-party claims caused in whole or in part by your negligence and/or intentional acts or omissions.
4. GENERAL CLUB RULES AND REGULATIONS
The Member agrees to abide by the club rules and regulations at all times and such other rules and regulations made by World Gym from time to time. These will be posted in a conspicuous place on the premises.
You may be refused entry, have your membership suspended or terminated if you do not follow the club rules and regulations. This includes, but is not limited to the following conditions:
· Entering the facility under the influence of alcohol or drugs is strictly prohibited.
· Sexual or racial harassment, or any kind of harassment/intimidation is not accepted.
· You must be respectful to our staff and members.
TOWELS
You are required to use a clean towel when training at any World Gym location. This is to be used on all equipment, during personal training sessions and in exercise classes. If you do not have a towel with you, you may be asked to leave the facility. You can purchase towels from most World Gym Pro Shop locations.
CLOTHING AND FOOTWEAR
Members and Guests are required to wear appropriate clothing, and enclosed footwear at all times. Work boots, thongs, and crocs are not appropriate enclosed footwear and are not permitted to be worn when training.
Our Posing Rooms are dedicated for posing practice, and the only area in the facility where you can wear posing heels, and appropriate posing attire.
EQUIPMENT USE
All equipment must be used in a respectful manner and dropping of any equipment/weights is not allowed. All weights, platers, dumbbells, barbells and any other equipment, shall be returned to its rack, stand or place of origin after use.
5. LOCKERS, BAGS AND LOST PROPERTY
Lockers and storage shelves are provided for members to place their personal belongings in whilst training. Bags are not permitted on the gym floor and must be placed in the lockers/storage provided. World Gym is not responsible for any lost or damage to personal property and recommends you do not bring any valuables into the club.
Lockers are not to be used as overnight storage and will be cleared daily.
6. FILMING, MARKETING AND SOCIAL MEDIA
Your image may be indirectly taken and used for promotional and marketing materials. You must notify us in writing if you do not wish for this to occur.
You must not use film or photograph other members; this will be a direct breach of your membership agreement and may result in termination.
You cannot use cameras, camera tripods, external photographers or videographers without the permission of World Gym Australia.
7. TRANSFERS
a. Transfer Location:
World Gym Australia memberships can be transferred to another World Gym Australia branch. You may be required to enter a new membership agreement, and your fees can be varied to reflect your new home club fees.
b. Transfer to another person:
Your World Gym membership can be transferred to another member, only if agreed to by your home club. Your membership account must be up to date, and you must be still within your minimum term. The person must also meet eligibility requirements, including signing an agreement with the World Gym branch, and a new Debit Success (DDR) agreement.
WORLD GYM AUSTRALIA PASSPORT MEMBERSHIP
a. Passport Membership: A member can use participating World Gym clubs if they join up as a Passport Member depending on the Passport type. When a Passport member joins their contract is with World Gym Australia. A Passport member pays a higher fee than a standard member which is a fixed rate set by World Gym Australia. A Passport member must join up at the club they most frequently use (“Home club”) and may use other participating World Gym clubs (“Away clubs”). World Gym franchisees sell Passport memberships for World Gym Australia.
b. Transfers of Passport memberships between clubs may automatically occur from time to time. If over a 2-month period a Passport Member’s visits are greater than 60% at an away club and in-line with the World Gym Australia Passport Membership Policy, from that time that club will be designated as the Member’s home club. This club will then be considered your HOME club and all other clubs AWAY clubs. When transferring your membership fees may increase to meet the minimum requirements of your new home club location.
9. FITNESS PASSPORT
Some of our World Gym locations allow access to Fitness Passport Members. You are required to purchase an access card from the location you wish to be your home club, and complete onboarding paperwork.
If you are a current World Gym member within your minimum term and wish to change to a Fitness Passport Membership at your location, you can request this by contacting your home club. You may be required to pay a cancellation fee or provide a cancellation notice period.
10. TRAVEL PASSES
You are entitled to receive 1 x Travel Pass per calendar year. A Travel Pass enables you to visit other World Gym locations outside of a 50km radius to your ‘home club’, for up to 10 visits per calendar year. You must present your World Gym Travel Pass displaying the valid current year to reception at the club in which you are visiting. A Travel Pass can only be used within staffed hours. You must collect your Travel Pass from your home club. T&C’s may apply.
11. ACCESS TAG AND SECURITY
a. You will need an access card to enter the facility. This must be swiped on entry every time.
b. You must not lend your access card to anyone. Failure to adhere to this, may result in a minimum $150 tailgating fee applied to your account and membership cancellation.
c. If you lose your access card you must notify the facility immediately and get a new access card within 7 days. You will be required to pay for a replacement access card fee. You may be refused entry if you do not have an access card.
12. SECURITY AND SAFETY
a. Security Cameras and CCTV: World Gym Australia locations have CCTV installed and recording in all appropriate areas within the facility. By entering the facility, you acknowledge and consent to being recorded under CCTV, for the purpose of security and safety reasons.
b. Incidents: If there are any incidents that you witness or are a part of you must notify the World Gym location and may be required to fill in an incident report form.
13. PERSONAL TRAINERS AND THIRD-PARTY CONTRACTORS
World Gym offer additional services such as personal training, physiotherapy, beauty and massage. These services may be contractors or employees. In cases, where they are contractors all payments are directly associated with the contractor and not World Gym Australia. All bookings are to be made directly with the contractor.
Only World Gym authorised Personal Trainers and third-party contractors are approved to operate on site. Conducting personal training or any business-related contracting service, may result in the termination of your membership.
Bringing into the facility a personal trainer or third-party contractor that is not authorised, may result in the termination of your membership.
Working with a personal trainer or third-party contractor, within the facility location, that is not authorised, may result in the termination of your membership.
14. RENEWALS AND UPFRONT MEMBERSHIPS
If you enter into a fixed term agreement or upfront membership, your membership will automatically expire at the end date of the agreement term. If you decide to renew your fixed term agreement or upfront membership, the current membership rates and terms will apply at the time.
15. GROUP FITNESS BOOKINGS
Several World Gym locations have enabled a booking system, which is available through the World Gym Australia App. Failure to attend a group fitness class booking may result in a no-show fine of up to $20.
An instructor may refuse entry if you are late to a scheduled group fitness class.
16. BREACH OR DEFAULT OF MEMBER
Any breach or default of the Member of this Agreement shall permit World Gym Australia to terminate, suspend or revoke membership. World Gym Australia shall have the right, to the extent permitted by law, to enforce any one or more remedies under this Agreement whether successively or concurrently and such action shall not operate to bar or stop World Gym Australia from pursuing any other remedy that World Gym Australia may have under this Agreement or otherwise.
17. MEMBERSHIP HOLD
A member may from time to time have unique circumstances that prevent them from using their membership, such as pregnancy, prolonged travel, or disability. During these times, a membership may be placed on hold status. A fee may be charged while a hold is in effect. A written request must be submitted to your World Gym home club location for consideration of hold status. You must provide a minimum of 3 days’ notice prior to the commencement of your membership hold start date request.
For general membership hold requests, you can request for a minimum of 2 weeks and a maximum of 4 weeks per calendar year, unless agreed upon by the club. A suspension fee of up to $5 per week, will be applied to your account.
For medical membership hold requests, you must provide a valid and current medical certificate. A medical suspension fee will not be charged to your account and will be free for the duration of your medical suspension.
If your membership is within minimum term, any hold requests do not count towards a full-payment, and your memberships minimum term end date will be extended.
18. MEMBERSHIP CANCELLATIONS AND TERMINATIONS
All membership cancellations are directed to your home club facility and must be completed in writing. Any scheduled direct debit payments are still applicable during the cancellation notice period.
a. COOLING OFF PERIOD
Your membership is subject to a 7-day cooling off period, in all states/territories excluding Queensland. Your cooling off period commences from the start date of your membership agreement.
Queensland memberships are subject to a 48-hour cooling off period, which commences from the start date of the agreement.
You may cancel during the cooling off period at any time by providing written notice to your home club location. A reasonable administration fee will be non-refundable.
b. CANCELLING AFTER THE MINIMUM TERM IS COMPLETE
Requires 30 days’ notice in writing. A Cancellation Form must be completed at your home club facility. If unable to visit the facility, you can cancel via email. Please contact your home club facility for details.
c. CANCELLING WITHIN THE MINIMUM TERM
CANCELLATION FEE: You may cancel your membership within the minimum term at any time, if you are to pay an upfront and in whole cancellation fee. A cancellation fee is equal to 50% of the remainder of your minimum term amount. This does not apply if your minimum term remaining is 30 days or under.
MEDICAL CANCELLATION: You can cancel your agreement by providing a medical certificate advising of “permanent incapacity to exercise”. A 30-day cancellation notice period may apply.
BANKRUPTCY: You may cancel your membership within the minimum term if you are declared bankrupt and provide documentation from the Australia Financial Security Authority (AFSA).
CANCEL BY MINIMUM TERM END DATE: During your memberships minimum term, you can request to cancel by the minimum term end date of the agreement. If you are within 30 days of the final minimum term end date, this option cannot be applied, and you will be required to provide 30 days’ notice. Please note, that your membership will continue until all payments have been met within your minimum term membership agreement, and the total value of the membership contract has been received.
d. WORLD GYM TERMINATING YOUR MEMBERSHIP AGREEMENT
World Gym Australia and/or any individual World Gym locations have the right to terminate your membership agreement effective immediately in the following circumstances:
· You have breached this agreement in anyway.
· You have breached club rules and regulations.
· To protect the health, safety and wellbeing of yourself, members and/or staff.
· We reasonably believe you have engaged in any inappropriate conduct.
19. PAYMENTS BY DIRECT DEBIT
It is your responsibility to ensure that on the due date funds are available in your nominated account to meet the direct debit payment.
In the event of a reversal or unsuccessful debit, the following will occur:
· You will be charged a penalty/service fee of $14.95 for each time this reversal occurs.
· This amount will be attempted in line with your next scheduled debit date, along with the missed membership payment.
The above will continue to reoccur until one of the following:
· You make a payment via www.paynow.debitsuccess.com
· You have a cleared payment.
20. OVERDUE FEES AND REVOCATION OF MEMBERSHIP
If you fail to meet your payment obligation and fall into arrears, your access may be revoked and entry refused into club. World Gym has the right to recover the debt before the next scheduled direct debit. You may be contacted via call, email or SMS to be notified about any overdue fees. If any unpaid membership fees remain outstanding after multiple attempts of contact, your membership may be forwarded to a third-part debt collection agency.
21. MEMBERS RESPONSIBILITIES – CONTACT DETAILS
You are required to keep all personal information up to date, including contact details and your direct debit account information. You are to notify your World Gym home location if there are any updates needed.
22. MINORS AND AGE POLICY
To obtain a membership, you must be a minimum of 14 years of age. Minors under the age of 18 are required to have parental or legal guardian consent to join, and the required paperwork must be completed. This includes completing a parental guardian consent form at the time of joining.
AGE POLICY
16 – 17 years
· Have full use of the facility, including 24 hour access.
14 – 15 years
· Does not have 24 hour access, and can only train during staffed hours.
· Must be supervised by a parent, guardian or trainer while in the facility.
· Can do cardio, bodyweight and resistance training. Heavy weightlifting is not advised.
23. MEMBERSHIP FEE INCREASE
After the completion of your minimum term agreement, your membership may be subject to an annual CPI (Consumer Price Index) increase of up to 3%. You will be given a minimum 2 weeks’ notice for any changes made to your agreement.
24. OTHER TERMS AND CONDITIONS
This Agreement shall be subject to all other terms and conditions as set out on any attachments to this Agreement and no amendment of this Agreement shall be binding upon either party unless reduced to writing and signed by both parties.
Our membership terms and conditions may change, and we will ensure you have been provided notice of any amendments made. This can be via one of the methods below, or alternative ways we find suitable.
· A notice displayed in club.
· An update in a newsletter.
· Published on our website.
· Contact via email, postal letter or phone.
25. LICENCE
World Gym Australia is a licensee of World Gym International, LLC, is independently owned and operated, and is permitted to operate under the name “World Gym Australia”. The Member acknowledges and agrees that the Facilities are operated solely by World Gym Australia and not World Gym International LLC. The Member acknowledges and agrees that neither this agreement nor use of the Facilities shall give rise to any right to bring a claim of any nature whatsoever or howsoever against World Gym International LLC and hereby releases any and all claims against World Gym International LLC that he or she now, or may in the future have, for any loss, injury or damages of any nature, whether arising under this agreement, from use of the Facilities or otherwise.
26. MEMBER’S CERTIFICATION OF UNDERSTANDING
The undersigned member certifies that:
a. I have read, understand and agreed to the terms of this Agreement and the rules and regulations of World Gym Australia;
b. I agree to abide by the rules and regulations of World Gym Australia;
c. I acknowledge and understand that this membership is not based on usage and that I am bound to the terms of this Agreement regardless of how often I use the Facilities;
d. I have been advised to consult a physician before I use the Facilities;
e. I acknowledge exercise, and in particular, weight training and aerobics, strenuous exercise may cause damage to my health and wellbeing without professional direction and my physician’s advice;
f. The terms and conditions of membership attached form part of this Agreement;
g. I acknowledge receipt of a true copy of this Agreement and attachments.
